Emergency Preparedness for Immigrant Families: Options for Childcare Planning in New York State

by CBJC Staff July 1, 2025

Over half of children in New York City have at least one immigrant parent. Many live in “mixed-status” families—where some family members are U.S. citizens or legal residents, and others are undocumented. With rising immigration enforcement, many parents are worried about who will care for their children if they are detained or deported.

Options for Childcare Planning in New York State

Parents can legally authorize another trusted adult to care for their children if they’re unable to do so. These options vary in length and how much control parents keep. Some are simple forms; others need court approval. Options include:

  • Informal planning
  • Parental Designation form
  • Standby Guardianship
  • Legal Guardianship

These plans allow the caregiver to make important decisions for the child, like those involving health, school, or money. The Immigrant Justice Project provides resources in English, Spanish, and French to help families understand these options.

Before choosing a plan, parents should ask:

  • How long will someone need to care for my child?
  • Do I want to stay involved from abroad?
  • Should the caregiver handle medical or financial matters?
  • Do I need short-term or long-term help?
